In our games magic quality gems HAD to be brilliant and flawless.  The size for EL sounds like a good rule to add.  Perhaps it should be MEL+EL, depending on the size of gems that are generally found.

Another potential way to determine magic for gemstones rather than it
having to be large and flawless is to have the prerequisite be flawless
with brilliant clarity and the size (1-10) determining the maximum EL of
any magic that can be contained in the gemstone.
